A young woman was seriously injured in a Canoas supermarket (RS) after being hit by a load with 1 ton of condensed milk. The establishment can be held responsible for the accident, according to Felipe Kirchner, leader of the Center for Collective Guardianship of the State Public Defender’s Office (DPE).
A pallet with boxes of the product fell on the customer last Sunday while an employee of the supermarket Via Atacadista operated an equipment. She, who is 19 years old has been taken to a hospital, must undergo surgery on the pelvis and the establishment is bearing the medical costs.
Kirchner points out that the Consumer Protection Code determines that the responsibility in these cases is objective and that it is enough for the consumer to prove three elements: the fact (accident), the damage (injuries suffered) and the causal link between them.
“It’s not worth talking about guilt. What matters is that there was damage and the damage has to be repaired,” he told g1. He points out that the repair must be integral, covering medical costs, loss of income, rehabilitation expenses and physical and psychological impacts of the victim.
